Malt Brand Homes - Terms & Conditions:

By purchasing a ticket to our Malt Brand Homes (“Distillery”), you agree to the following T&Cs. Please ensure all guests in your party are aware of and agree to comply with these T&Cs. 

Your Tickets and your Visit  

1. No person shall be permitted to enter the Distillery without a valid ticket. In purchasing this ticket, you are transacting with Diageo Scotland Limited.  

2. All prices are quoted in pounds sterling (£). Whilst we reserve the right to increase or decrease our prices at any time before you book, once your booking is confirmed the price of your booking as stated in the confirmation email shall not be altered.  

3. Tours can only be rescheduled or cancelled if the Distillery receives such notice at least 48 hours before the time of the tour booking. Please refer to your booking confirmation email for the relevant contact details.  

4. For health and safety reasons, children under 8 years old are not permitted in the production areas of the Distillery or on any of the Distillery’s allotted tours. Children under 8 years old are permitted in the shop and certain exhibitions. A child ticket is for children aged between 8 and 17 years inclusive. Children under the age of 18 must at all times, whilst at the Distillery, be accompanied by an adult who is 18 years or above. We reserve the right to request you to provide proof of age.  

5. Please arrive at the Distillery at least 15 minutes prior to the start of your allotted tour time-slot. If you are late, we shall assume that you have failed to attend, and we reserve the right to continue the tour at the scheduled time in your absence. If you are late or you miss your allotted booking time, it is very unlikely that we will be able to reallocate you or your party to another slot, and, for the avoidance of doubt, we are in no circumstances obliged to do so or to offer you a refund.  

6. We cannot guarantee that the Distillery will be in production during your visit. Breaks in production or essential maintenance may restrict viewing and if the Distillery is not in production on the day of your visit, we shall be under no obligation to refund your ticket and the ticket cannot be used or reallocated for any subsequent tours. However, if there is a substantial disruption to your visit, we will refund you the cost of your ticket. Otherwise the Distillery and Diageo Scotland Limited shall have no liability whatsoever, including no liability for travel expenses or any other out of pocket expenses in respect of closure of part or all of the Distillery.  

We reserve the right to close the Distillery and cancel your tour for operational reasons or factors beyond our control. In this event we will notify you as soon as possible (using the email address you provided) and offer to refund your tickets or arrange an alternative date.  Please note that any booking and/or transaction fees are not refundable. 

Personal arrangements including travel, accommodation or hospitality relating to your visit to our site are at your own risk. We shall not be responsible for any costs or expenses relating to any other services that you may have arranged.    

Health and Safety 

As this is a working distillery and there may be steep stairs and ramps in places, please ensure you wear appropriate footwear – i.e. flat and closed shoes. We will not be liable for any damage to or injury resulting from the wearing of inappropriate footwear. 

Please contact us in advance if you have any sight, hearing or mobility concerns or would like more information on the physical layout of the site. There are areas that may not be accessible by wheelchair. Due to health and safety reasons, no pet animals are permitted in the operational parts of the Distillery. If you require use of an assistance dog, please contact us before making your booking so that we can discuss your needs. If you are unsure whether the Distillery tour is right for you, please contact us before making your booking on 01875 342012 or at talisker@malts.com and we will be able to assist you.  

As this is a working distillery, it can get warm in some areas (particularly in the summer months) and there may be vapours and smells related to production. Visitors are welcome to bring bottled water into the distillery. If you feel uncomfortable or unwell at any point during your tour, please tell your guide immediately. This environment may not be suitable for guests with pre-existing health conditions. We will not be liable for illness or injury arising from visiting the distillery, except where we are negligent. Please stay with your tour group and follow the instructions of your guide at all times. Do not touch any equipment unless invited to do so by your guide (some of it can be very hot). Smoking is not permitted anywhere at the site except specially designated smoking areas.   

Visitor Conduct 

We reserve the right to refuse admission or require you (and other members of your group) to leave the distillery in reasonable circumstances, including for health and safety reasons or if you: breach these booking terms; are involved in any abusive, threatening, drunken or other anti-social behaviour; are acting under the influence of, or carrying, any illegal or prohibited substances; make unauthorised audio, video or photographic recordings; or are dressed inappropriately.  No refunds will be given to persons who are refused entry or who are required to leave due to their own behaviour as suggested in, but not limited to, the examples above.     Please do not leave baggage and/or personal items unattended at any time. We will not be liable for any loss, theft or damage to personal items. You will not be able to bring or wear large bags on distillery tours. We will make drivers’ packs available for anyone who did not enjoy drams as part of their tour. In Scotland there is zero tolerance meaning it is illegal to consume any amount of alcohol and drive.  

Filming and Photography 

Cameras may be used for private purposes only, however, for safety reasons the use of photographic and recording equipment may be prohibited in certain areas as notified by your guide before entering such areas. We reserve the right to confiscate and destroy unauthorised recordings, films or similar items without liability.   

CCTV may be in operation at the Distillery for the purposes of safety and security including the detection and prevention of crime.  

From time to time, filming/photography may take place at the Distillery for promotional purposes by Diageo Scotland Limited and our authorised third parties which may feature visitors. You consent to such photography/filming and the use of such images in any media in connection with advertising or promotions without renumeration and acknowledge that the copyright in such images rests with Diageo Scotland Limited or relevant third party. If you do not wish to be filmed, please contact a member of the staff when you are at the Distillery. .   

This contract is between the ticket holder and Diageo Scotland Limited. No other person shall have any rights to enforce any of its terms.  

Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.  

These Terms are governed by Scottish law and you can bring legal proceedings in respect of your purchase in the Scottish courts. 

Click and Collect  

1. Click and collect orders require to be collected on the date of your visit at the collection point. We will keep your order aside for 7 days and after such time if it is not collected, we will refund you, which should take 3–5 working days to reach your account.  

2. Your booking reference number will be required at the collection point (and proof of age may also be required).  

3. If you wish to cancel your click and collect order prior to collection, please contact us at talisker@malts.com. Please allow 3–5 working days for your refund to reach your account.  

4. All other statutory rights apply.

Clynelish Festive Cocktail Terms and Conditions (the "Promotion") :

1. The Promotion is open to all residents of United Kingdom (excluding Northern Ireland) aged 18 or over.

2. Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion.

3. The Promotion is free to enter and no purchase necessary.

4. To enter the Promotion, you must create a Christmas Cocktail and publish a photo of it under our Christmas cocktail Facebook post of November 11th, between November 11th at 12:00pm and 15th November 12:00pm. This must include a photo and all the ingredients, including their measurements and method that was used. Entries received outside of this time will be void and will not be entered into the Promotion. Only one entry is permitted per person.

5. There will be one winner.

6. The winner will be the first valid entry electronically drawn at random from all entries correctly submitted in accordance with these terms and conditions, on 18th November at 12:00pm and notified via Facebook Direct Message on or before 20th November at 12:00pm.

7. If the winner does not respond to the notification on or before 22nd November at 12:00pm their prize will be forfeited and an alternative winner may be selected by the same process as set out above at the Promoter’s sole discretion.

8. The Promoter will verify the eligibility of all entrants. The Promoter will require as much information as it considers reasonably necessary for this purpose and the Prize may be withheld unless or until the Promoter is satisfied with the verification. Entrants who use anonymous email services such as, but not limited to, GuerillaMail, Dispostable, Mailinator or Apple’s “Hide my Email” feature will not be entered into the Promotion. Winners that do not fulfil the requirements set out in these terms and conditions will be disqualified.

9. The Prize for the winner is to have their festive cocktail on the Clynelish Distillery menu during our festive season, and receive a complimentary Flavour Journey tour for 2 people, followed by 2x servings of their festive cocktail. This can only be redeemed at Clynelish Distillery, and must be redeemed before 31st March 2025. The Prize does not include transfer to and from the distillery. It does not include any extras from the bar or shop.

10. The winner and any companion(s), who must attend with the winner, must be over 18.

11. You need to redeem this prize before March 31st 2025, and this not flexible. If the event, for reasons outside the control of the Promoter the Prize cannot take place on the proposed date or the proposed location an alternative date and/or location will be designated. The Promoter will have no liability or responsibility if the winner or their companion cannot attend on the revised dates or to the revised location.

12. To the maximum extent permitted by law, the Promoter shall not be liable for any loss and/or personal injury suffered by or to the winner and/or any of their companions that occurs as a result of the winner’s and/or their companions’ participation in the prize.. The taking of the Flavour Journey Tour is subject to the winner agreeing to the contractual terms of the Flavour Journey provider which are available at [https://www.malts.com/en-gb/distilleries/clynelish#id=clynelish-flavour-journey].

13. The prize is non-transferable and there is no cash alternative. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

14. The Promoter will use your personal information only in accordance with these terms and conditions and our privacy policy which can be found at https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with Diageo Scotland Limited, who is responsible for the fulfilment of and delivery of the prize.

15. Subject to paragraph 18 and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request (which includes a stamped addressed envelope for such a response) to Clynelish Visitor Centre, Brora, Sutherland, KW9 6LR / clynelish@malts.com, the winner's surname and county, and (if applicable) the winning entry.

16. Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 17 by writing to Clynelish Visitor Centre, Brora, Sutherland, KW9 6LR / clynelish@malts.com. However, the Promoter shall provide the information set out in paragraph 11 upon request from such competent authorities (including the Advertising Standards Authority).

17. The winner may be asked to take part in publicity.

18. The Promoter does not claim any rights of ownership in your competition entry.

19. Submissions entered into the Promotion must be original, created by the entrant and not copied from any other work or material.

20. By entering your competition entry into the Promotion, you grant to the Promoter a non-exclusive, perpetual, worldwide, irrevocable, royalty free licence to use, display, publish, transmit, copy, edit, alter, store, re-format, sub-licence or exploit the competition entry including (but not limited to) the right to publish your competition entry entered into the Promotion in any media at all times without restriction or limitation.

21. By entering the Promotion, you waive the right to be credited when your competition entry is displayed and irrevocably and unconditionally waive other moral rights relating to the use of your competition entry.

22. Entries that contain images of identifiable individuals will not be accepted and will not be entered into the Promotion

23. You promise that: (i) you have the right to grant the licence set out in paragraph 18; (ii) the competition entry entered into the Promotion is an original design created by you and has not been copied from any other work or material; and (iii) the competition entry entered into the Promotion or anything within it does not require any permission from anyone else for it to be used in the Promotion (including any permission to use the design for commercial purposes).

24. If the Promoter suspects that any competition entry submitted as an entry to the Promotion may breach any third party intellectual property rights, your competition entry will be discarded and will be disqualified at the Promoter's discretion.

25. The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside their reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud or in the event of technical or other difficulties that might compromise its integrity).

26. Entries that contain any offensive or inappropriate content will be deleted and disqualified at the Promoter's discretion.

27. No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.

28. The Promoter and their agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.

29. The Promotion and the Promoter's Clynelish Distillery / Diageo pages are not sponsored, endorsed or administered by, or associated with, Facebook. By entering into the Promotion, entrants release Facebook from all and any claims and liabilities which might arise in relation to the Promotion. You understand that you are providing your information to the Promoter and not to Facebook. The information you provide will only be used for communications associated with this promotion in accordance with paragraph 10 or for further communication if you have specifically opted into receive this.

30. While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.

31. This Promotion and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English Courts.

32. Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.

Ballot for Ian’s Farewell Dram, Lagavulin 18 Year Bottle – Terms and Conditions:

Ballot for Ian’s Farewell Dram, Lagavulin 18 Year Bottle Terms and Conditions (the "Ballot") Lagavulin fans will be excited to learn that 14 of the remaining bottles are available and being offered via a ballot system, both online and in the shop at the distillery on Islay.

  1. The Ballot is open to all residents of United Kingdom (excluding Northern Ireland) aged 18 or over.

  2. To enter the Ballot, you must complete the form online at https://www.malts.com/en/distilleries/lagavulin#id=ballot-for-iain-s-farewell-dram-lagavulin-18y before 5pm on 31st December 2024.

  3. The Ballot is free to enter, and if successful, a winner can purchase a bottle.

  4. Only one entry per person.

  5. There will be fourteen Winners, one bottle per Winner.

  6. The (“Winners”) will receive a chance to purchase a Lagavulin 18-Year-Old Single Malt Scotch Whiskey bottle, hand-filled at the distillery by Iain McArthur.

  7. The Winners will be selected by an automatic generator, from all entries correctly submitted in accordance with these terms and conditions, on 8th January 2025 from all entries correctly submitted in accordance with these terms and conditions.

  8. If successful, to accept the offer, Winners must reply to the email confirming their acceptance, then pay £350 online, before midnight on 31st January 2025.

  9. Bottles must be collected from the Lagavulin shop at Lagavulin Distillery, Port Ellen, isle of Islay, PA42 7DZ before 31st December 2025, providing the confirmation email and a form of ID. As this is a hand-filled bottle, this cannot be sent via mail. The Winners must cover their own cost of travel to Lagavulin Distillery.

  10. If the Winners do not purchase their Bottle by the time end of 31st January 2025, the offer to purchase is automatically withdrawn and an alternative Ballot entrant will be selected at random by the same process as set out above at the Promoter’s sole discretion.

  11. The chance to purchase is non-transferable and there is no cash alternative.
